Yes. Foreigners can own a condominium unit freehold, in their own name, as long as foreign ownership in that building stays under the legal cap of 49% of total saleable floor area. The remaining 51% must stay Thai-owned. Land and houses work differently — foreigners generally can’t hold land directly, so villas are usually bought via leasehold, a properly structured Thai company, or registration in a Thai spouse’s name.
