How a Pattaya Condo Ownership Transfer Works

Every sale we close ends the same way: buyer and seller (or their representatives) meet at the Land Office, the fees are calculated and paid, and the unit is registered in the buyer’s name. Behind that one day are three steps that decide whether it goes smoothly.

1. Check the foreign quota before agreeing a price

A foreigner can only take freehold ownership in their own name while the building’s foreign quota is still open. Up to 49% of the total sellable floor area of a condominium project may be owned by foreigners, and once that quota is full no further foreign freehold transfers are allowed in that building. Quota status should therefore be confirmed with the building before any deposit is paid.

2. Bring the purchase money in from overseas

For a foreign-name transfer, the funds must be sent to Thailand from overseas in foreign currency, and the receiving Thai bank issues a Foreign Exchange Transaction form (FET) for the payment. Our guide on how to transfer money to Thailand to buy a condo covers this step in detail.

3. Know the transfer-day costs

The Land Office calculates the final amounts on the day, using its appraised value and the sale price. The main items are:

  • Transfer fee: 2% of the Land Office appraised value (foreign buyers pay the standard 2%), usually split 50/50 between buyer and seller unless the contract says otherwise
  • Specific business tax: 3.3% when the seller is a company, or an individual selling within 5 years who has not been on the house registration for at least 1 year
  • Stamp duty: 0.5%, only when specific business tax does not apply
  • Withholding tax: 1% for a company seller, progressive for an individual seller

Who pays the seller taxes can be negotiated, so it should be written into the sales contract. To estimate the figures for any price, use our Pattaya property buying cost calculator.

Pattaya Condo Ownership Transfer FAQ

Can a foreigner own a Pattaya condo in their own name?

Yes. A foreigner can own a condo unit freehold in their own name as long as the building’s 49% foreign quota is not full and the purchase money was brought in from overseas in foreign currency.

Where does the transfer take place?

Ownership is registered at the Land Department office that covers the property. Official information is published on the Thai Department of Lands website.

Can I buy a unit if the foreign quota is full?

Not in a foreign name, because the remaining 51% of the floor area must be owned by Thai nationals or Thai-registered entities. Our Thai company vs foreign quota guide explains how the two options compare.

Who pays the transfer fee?

The 2% transfer fee is usually split 50/50 between buyer and seller, but it is negotiable and the sales contract decides. Developers selling new units may set their own split, so check the contract before you sign.
